Data Use Policy: Occasional use of the MesoWest data does not require submission of a formal application. The graphics and files that are available on the MesoWest Web Page and the ftp server can be used without restriction. Uses of MesoWest data that require approval via the application process include commercial uses of data, use of data to examine policies and procedures of participating networks in MesoWest, and any other use that is not related to work of a formal government or educational institution.

The user assumes the entire risk related to use of MesoWest data. MesoWest provides the data "as is" and in no event shall the providers be liable for any damages, including, without limitation, damages resulting from lost data or lost profits or revenue, the costs of recovering such data, the costs of substitute data, claims by third parties or for other similar costs, or any special, incidental, or consequential damages, arising out of the use of the data. The accuracy or reliability of the data is not guaranteed or warranted in any way and the Providers disclaim liability of any kind whatsoever, including, without limitation, liability for quality, performance, merchantability and fitness for a particular purpose arising out of the use, or inability to use the data.

As required by 17 U.S.C. 403, third parties producing copyrighted works consisting predominantly of the material appearing in NWS Web pages must provide notice with such work(s) identifying the NWS material incorporated and stating that such material is not subject to copyright protection.
